Terms and Conditions for Job Application Portal

Welcome to the official job application portal of Philippine Airlines and Air Philippines Corporation (doing business as PAL Express) (both referred to as "the Airline," "we," "us," or "our"), powered by SAP SuccessFactors. These Terms and Conditions ("Terms") constitute a legally binding agreement between you, the applicant ("you," "your," or "Applicant"), and the Airline, governing your access to and use of this job application portal and the submission of your job application. 

By accessing, browsing, or submitting an application through this portal, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms or our Privacy Policy, you must not use this portal or submit an application. 

1. Acceptance of Terms 
Your use of this job application portal and the submission of your application signify your express and unequivocal acceptance of these Terms. By clicking any "Submit," "Apply," "I Agree," or similar button, or by otherwise proceeding with your application, you are entering into a legally binding contract with the Airline.  

You affirm that you are of legal age and capacity to enter into this agreement. 

2. Eligibility 
To apply for a position through this portal, you must:

  • Be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, whichever is higher. 
  • Be legally authorized to work in the Philippines or possess the necessary qualifications for a work visa if applying from outside the Philippines for a position based in the Philippines. 


3. Your Responsibilities as an Applicant 
As an Applicant, you agree to: 

  • Accuracy of Information: Provide only true, accurate, current, and complete information in your application, including your personal details, educational background, employment history, and any other requested data. You understand that any false, misleading, or incomplete information may lead to the disqualification of your application, withdrawal of an offer of employment, or termination of employment if discovered after hiring. 
  • Honesty and Integrity: Conduct yourself with honesty and integrity throughout the application and recruitment process. 
  • Security of Account: If the portal requires account registration (as is common with SAP SuccessFactors), you are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify the Airline immediately of any unauthorized use of your account. 
  • Prohibited Conduct: Not use this portal for any unlawful, fraudulent, or malicious purpose, including but not limited to: 
    • Submitting applications on behalf of others without their explicit consent. 
    • Attempting to gain unauthorized access to the portal or its systems. 
    • Introducing viruses, malware, or other harmful code. 
    • Engaging in any activity that could damage, disable, overburden, or impair the portal. 
    • Violating any applicable laws, regulations, or third-party rights. 


4. Data Privacy and Protection 
The Airline is committed to protecting your privacy and personal data in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations, as well as the issuances of the National Privacy Commission (NPC). This section outlines how your personal data will be collected, processed, and protected during the application process. For more detailed information, please refer to the Airlines' Privacy Policy. 4.1 Personal Information Controller 
The Airline, with its principal office located at Lucio K. Tan, Jr. Center, PAL Gate 5-A, Andrews Avenue, Pasay City, Philippines 1300, is the Personal Information Controller responsible for the processing of your personal data submitted through this portal. SAP SuccessFactors acts as a data processor for the Airline, facilitating the secure collection and management of your application data in accordance with our instructions and these Terms. 

4.2 Data Collected 
In connection with your job application, we may collect various types of personal data, including but not limited to: 

Phase 1: Recruitment (Pre-Employment and Conditional Offer) 
During the initial application and pre-employment assessment, the primary objective is to evaluate a candidate's suitability for a role. Data collected is inherently tied to this purpose. 

A. Personal Information Collected and Processed 

   1. Identity and Contact Information: 

  • Full Name (including maiden name, if applicable, for future record consistency). 
  • Date and Place of Birth (for age verification, legal working age). 
  • Nationality (for work authorization/visa requirements). 
  • Gender (for demographic reporting, though sensitive use must be justified). 
  • Civil Status (relevant for government reporting, and medical coverage post-onboarding). 
  • Current and Permanent Residential Address. 
  • Email Address and Contact Numbers (mobile, landline). 
  • Photograph (e.g., passport-sized ID picture for identification). 
  • Government-issued ID details (e.g., Passport, Driver's License, SSS/UMID ID, PhilHealth ID, TIN ID, Pag-IBIG ID, PRC License)  

 
 2. Educational Background: 

  • Academic Institutions attended, degrees obtained, major/specialization. 
  • Dates of attendance/graduation. 
  • Academic honors/awards.
     

   3. Employment History: 

  • Previous employers' names, addresses, and industry. 
  • Positions held, dates of employment (start and end), and reasons for leaving. 
  • Key job responsibilities, achievements, and performance highlights.
     

   4. Skills and Qualifications: 

  • Technical and soft skills, language proficiencies. 
  • Professional Certifications, Licenses (e.g., Pilot License, PRC license number and expiration for regulated professions). 
     

   5. References: 

  • Names, contact details, and relationship of professional references.
     

   6. Application-Specific Information: 

  • Resume/Curriculum Vitae (CV) and Cover Letter. 
  • Desired Salary and Availability for employment. 
  • Responses to application questions (e.g., behavioral assessments, case studies).
     

   7. Sensitive Personal Information (Requires Explicit Consent and Strict Justification): 

  • Health Information (Post-Conditional Offer): Pre-Employment Medical Examination (PEME) is standard after a conditional job offer has been extended. 
    • Purpose: To ascertain fitness for work and ensure the individual can safely perform the inherent requirements of the job without endangering themselves or others, and for compliance with occupational safety and health regulations (e.g., DOLE Department Order 198-18). It also provides baseline data for future benefits/insurance. 
    • Information Collected: Results of physical exams, laboratory tests (e.g., CBC, urinalysis, fecalysis, chest X-ray, drug tests), and psychological assessments (for pilots).  
  • Criminal Records (Post-Conditional Offer): 
    • Purpose: To assess an applicant's integrity and mitigate risks and Civil Aviation Authority of the Philippines requirement. 
    • Information Collected: NBI Clearance (National Bureau of Investigation) result and Police Clearance. These disclose any criminal history or derogatory records. 
  • Marital Status, Religion, Political Affiliations: While technically sensitive, marital status is often collected for government reporting and future benefits.  
     

B. Documentary Requirements During Recruitment (Pre-Employment and Conditional Offer) 

Documents are requested to verify information and facilitate background checks. 

  1. Resume/Curriculum Vitae (CV)/LinkedIn or JobStreet Talent Profile: Initial comprehensive overview. 
  2. Application Form: Online or physical, detailing the applicant's submitted data. 
  3. Photocopy of Transcript of Records (TOR) and/or Diploma: For educational verification. 
  4. Photocopy of Certificates of Employment (COE): From previous employers to verify work experience. 
  5. Photocopy of Professional Licenses/Certifications: (e.g., Pilot License, PRC ID) 
  6. NBI Clearance: Required for criminal background checks. (Submission is requested post-conditional offer). 
  7. Photocopy of Valid Government-Issued ID: For identity verification. 
  8. PEME Clearance/Medical Certificate: The "Fit to Work" document from the accredited clinic. 
  9. Signed Consent Forms/Waivers: Especially for PEME, background checks, and reference checks.  


Phase 2: Onboarding (Post-Employment Offer and Contract Signing) 

Upon acceptance of a job offer and signing of the employment contract, the focus shifts to collecting information for legal compliance, payroll, benefits enrollment, and internal HR records. The legal basis expands to include contractual necessity and compliance with legal obligations (e.g., mandated government contributions). 

A. Personal Information Collected and Processed 

   1. Core Personal Data (Verified/Updated): 

  • Full Name, Date of Birth, Place of Birth, Nationality, Gender, Civil Status. 
  • Residential Address (current and permanent), Contact Numbers, Personal Email. 
  • Emergency Contact Information (Name, Relationship, Contact Number).  

   2. Financial Information: 

  • Bank Account Details (for direct payroll deposit). 
  • Tax Identification Number (TIN). 
  • Voucher of exiting SSS Salary Loan (if any) – for salary deduction continuity 
  • Voucher of exiting Pag-IBIG Multi-Purpose Loan (if any) – for salary deduction continuity 

   3. Government Mandated Contributions Information: 

  • Social Security System (SSS) Number. 
  • Philippine Health Insurance Corporation (PhilHealth) Number. 
  • Home Development Mutual Fund (Pag-IBIG) MID Number. 

4. Other Government-issued ID Requirements 

  • Alien Employment Permit – for foreign national hires 
  • Valid Passport – for pilot and cabin crew positions 
  • Solo Parent ID – for solo parent leave availment 
  • Driver’s License and Vehicle License Plate – for issuance of company parking stickers 

   5. Family Information: 

  • Spouse's details (name, date of birth, occupation) – for tax exemption purpose. 
  • Children's details (names, dates of birth) – for tax exemption purpose. 

   6. Other Compliance-Related Information: 

  • Information for professional affiliations or mandatory memberships i.e., bar membership 
  • Biometric Data (e.g., fingerprints) for timekeeping.  
  • Electronic Signatures – for accomplishment and execution of electronic documents 
     

B. Documentary Requirements During Onboarding 

These documents are essential for compliance with labor laws, government agencies, and internal HR policies. 

  1. PSA-Authenticated Birth Certificate: Original or certified true copy. 
  2. PSA-Authenticated Marriage Certificate: If applicable (original/certified true copy). 
  3. SSS Number/E-1 or E-4 Form: Proof of SSS membership. 
  4. PhilHealth Number/MDR (Member Data Record): Proof of PhilHealth membership. 
  5. Pag-IBIG MID Number/Membership Form: Proof of Pag-IBIG membership. 
  6. Tax Identification Number (TIN) Card/BIR Form 1902 or 2305: For tax registration/updates. 
  7. NBI Clearance (updated): Typically required to be less than 6 months old. 
  8. Medical Certificate/Health Clearances: Final PEME clearance. 
  9. Signed Employment Contract, Training Agreement: Original copy. 
  10. Original/Certified True Copy of Transcript of Records (TOR) and Diploma. 
  11. Original/Certified True Copies of Certificates of Employment (COE) / Service Records: From all previous employers. 
  12. Photocopies of Valid Government-Issued IDs: (e.g., Pilot’s License, Driver's License, Passport). 
  13. Bank Account Details/Bank Certificate: For payroll. 
  14. Professional Regulation Commission (PRC) License and Board Rating: If applicable (original/certified true copy). 
  15. NBI Clearance, Police Clearance, and Barangay Clearance: Airport Security Compliance as mandated by the Civil Aviation Authority of the Philippines. 
     

4.3 Purpose of Collection 

Your personal data is collected and processed solely for the following purposes: 

  • To assess your qualifications, skills, and suitability for the position(s) you have applied for. 
  • To verify the accuracy of the information provided in your application. 
  • To conduct background checks, including but not limited to employment, education, criminal, and financial history, as required by the nature of the position and applicable laws/regulations (e.g., aviation security regulations). 
  • To communicate with you regarding your application status, interview schedules, and other relevant recruitment matters. 
  • To comply with legal, regulatory, and statutory requirements (e.g., reporting to government agencies like DOLE, CAAP, or other relevant government agencies). 
  • To maintain a talent pool for future job opportunities, with your consent. 
  • To defend the Airline against legal claims or to establish, exercise, or defend legal rights. 
  • For internal statistical analysis and reporting related to recruitment and employment. 


4.4 Lawful Basis for Processing 

We process your personal data based on the following lawful criteria under the Data Privacy Act: 

  • Consent: By submitting your application and agreeing to these Terms, you provide your explicit consent to the collection, processing, and disclosure of your personal data, including sensitive personal information, for the purposes outlined herein. 
  • Legitimate Interest: To pursue the legitimate interests of the Airline in evaluating candidates and managing its recruitment process, provided that your interests and fundamental rights do not override these interests. 
  • Performance of a Contract: To take steps necessary for entering into an employment contract with you. 
  • Compliance with Legal Obligation: To comply with legal and regulatory obligations imposed on the Airline, particularly those related to aviation security, labor laws, and data privacy. 
     

4.5 Data Sharing and Disclosure 

Your personal data may be shared with, or disclosed to, the following parties, strictly for the purposes outlined in Section 4.3: 

  • Internal Departments: Relevant departments within the Airline involved in the recruitment and hiring process (e.g., Human Resources, hiring managers, department heads, security personnel). 
  • Third-Party Service Providers: External vendors and partners who assist us in the recruitment process, such as: 
    • Background check providers (for criminal records, employment verification, educational verification). 
    • Psychometric assessment providers. 
    • Medical service providers. 
    • IT service providers maintaining the application portal (including SAP SuccessFactors) and data storage. 
  • Government and Regulatory Authorities: Law enforcement agencies, regulatory bodies, and other government entities (e.g., National Privacy Commission, Department of Labor and Employment, Civil Aviation Authority of the Philippines, National Bureau of Investigation, Philippine National Police) when required by law, regulation, or court order, or for aviation security purposes. 
  • Affiliated Companies: Other entities within the Airline's corporate group, where necessary for recruitment or business purposes. 
  • Foreign Authorities (for international roles): If the position involves international travel or operations, your data may be shared with relevant foreign aviation authorities or government bodies as required by international regulations or treaties. In such cases, the Airline will ensure that appropriate safeguards are in place for cross-border data transfers, consistent with NPC Circulars (e.g., standard contractual clauses, binding corporate rules). 


We require all third parties with whom we share your data to respect the security of your personal data and to treat it in accordance with the law. They are only permitted to process your personal data for specified purposes and in accordance with our instructions and applicable data privacy laws. 

4.6 Data Security 

The Airline implements appropriate organizational, physical, and technical security measures to protect your personal data against accidental or unlawful destruction, alteration, and disclosure, as well as against any other unlawful processing. These measures include, but are not limited to, data encryption, access controls, firewalls, and regular security audits. The SAP SuccessFactors platform itself employs robust security features to protect your data.

4.7 Data Retention 

Your personal data will be retained for a period necessary to fulfill the purposes for which it was collected, or as required by applicable laws and regulations. 

  • For successful applicants: Your data will become part of your employee record and will be retained for the duration of your employment and for a period thereafter as required by labor laws, tax laws, and other relevant regulations. 
  • For unsuccessful applicants: Your data will generally be retained for a period of one (1) year from the date of application submission to allow for re-evaluation for similar roles, for internal statistical analysis, or for legal defense purposes, unless you specifically request its earlier deletion, subject to legal limitations. After this period, your data will be securely disposed of or anonymized. 


4.8 Your Rights as a Data Subject 

Under the Data Privacy Act, you have the following rights concerning your personal data: 

  • Right to Be Informed: To be informed whether personal data pertaining to you shall be, are being, or have been processed. 
  • Right to Object: To object to the processing of your personal data, including processing for direct marketing, automated processing, or profiling. 
  • Right to Access: To demand reasonable access to your personal data. 
  • Right to Rectification: To dispute the inaccuracy or error in your personal data and have it corrected immediately and accordingly. 
  • Right to Erasure or Blocking: To suspend, withdraw, or order the blocking, removal, or destruction of your personal data from our filing system. 
  • Right to Damages: To be indemnified for any damage sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of personal data. 
  • Right to Data Portability: To obtain a copy of your personal data in an electronic or structured format, if processed by electronic means and in a structured and commonly used format. 
  • Right to File a Complaint: To file a complaint with the National Privacy Commission if you believe your data privacy rights have been violated.

4.9 Reference to Privacy Policy 

These Terms provide a general overview of our data privacy practices. For a comprehensive understanding of how we handle your personal data, including detailed information on our security measures, data retention periods, and your rights, please review our full Privacy Policy (refer to no. 4 Data Privacy and Protection). By agreeing to these Terms, you also acknowledge and agree to the terms of our Privacy Policy. 

5. Application Process 

  • No Guarantee of Employment: Submission of an application through this portal does not guarantee an interview, an offer of employment, or any form of engagement with the Airline. 
  • Right to Modify/Withdraw: The Airline reserves the right to modify, suspend, or withdraw any job posting or the entire application process at any time, without prior notice. 
  • Discretion in Hiring: All hiring decisions are made at the sole discretion of the Airline, based on qualifications, experience, performance in assessments, background checks, and business needs. 


6. Background Checks and Verification 

By submitting your application through SAP SuccessFactors, you explicitly authorize the Airline, its agents, and third-party service providers to conduct comprehensive background checks, including but not limited to: 

  • Verification of educational qualifications and credentials. 
  • Verification of employment history and references. 
  • Criminal background checks (e.g., NBI Clearance, Police Clearance). 
  • Financial background checks (where relevant and proportionate to the requirements of the specific position, such as roles involving financial management or fiduciary responsibilities). 
  • Medical examinations as required for the role, especially for safety-sensitive positions. 

You understand that failure to provide necessary consents or information for these checks, or the discovery of adverse findings, may result in the disqualification of your application or, if already hired, termination of your employment. 

7. Intellectual Property 

All content on this job application portal, including text, graphics, logos, images, software, and the compilation thereof, is the property of the Airline or its licensors and is protected by Philippine and international copyright, trademark, and other intellectual property laws. 

By submitting your application materials (e.g., resume, cover letter, portfolio), you grant the Airline a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such materials solely for the purpose of evaluating your application and for internal recruitment and record-keeping purposes. 

8. Disclaimers 

This job application portal, powered by SAP SuccessFactors, and its content are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of information. The Airline does not warrant that the portal will be uninterrupted, error-free, secure, or free from viruses or other harmful components. 

9. Limitation of Liability 

To the fullest extent permitted by law, the Airline, its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from : 

  • your access to or use of or inability to access or use the portal;  
  • any conduct or content of any third party on the portal;  
  • any content obtained from the portal; and  
  • unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. 
     

10. Indemnification 

You agree to indemnify, defend, and hold harmless the Airline, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the portal. 

11. Termination of Access The Airline reserves the right, in its sole discretion, to suspend or terminate your access to the job application portal, or to remove any application or content you have submitted, at any time

and for any reason, including but not limited to a breach of these Terms. 

12. Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles. 

13. Dispute Resolution 

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by the competent courts of Pasay City, Metro Manila, Philippines, to the exclusion of all other courts. 

14. Amendments to Terms 

The Airline reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on this portal. Your continued use of the portal or submission of an application after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically for any updates. 

15. Severability 

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein. 

16. Entire Agreement 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Airline regarding your use of the job application portal and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and the Airline.
